2. Description of Services

Tripzera is a platform that connects travelers with independent travel advisors. We provide:

  • A directory of travel advisors with their profiles, specialties, and portfolios
  • Tools for travelers to search and connect with advisors
  • Communication tools for inquiries and consultations
  • Subscription services for travel advisors to list their profiles

Tripzera acts as an intermediary platform and is not a travel agency. We do not provide travel services directly.

3. User Accounts

To access certain features, you may need to create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Travel Advisor Terms

Travel advisors who join our platform agree to the following additional terms:

  • You are an independent contractor, not an employee of Tripzera
  • You will maintain all necessary licenses, certifications, and insurance
  • You will provide accurate information in your profile
  • You will respond to inquiries in a timely and professional manner
  • You are solely responsible for the services you provide to clients
  • Subscription fees are non-refundable except as required by law

5. Traveler Terms

Travelers using our platform agree that:

  • Tripzera is not responsible for the services provided by travel advisors
  • Any agreements or transactions with advisors are between you and the advisor
  • You will conduct your own due diligence when selecting an advisor
  • You will communicate respectfully and honestly with advisors

6. Payment Terms

For subscription services:

  • Payments are processed securely through our third-party payment processor
  • Subscriptions automatically renew unless cancelled before the renewal date
  • You may cancel your subscription at any time through your account settings
  • No refunds will be provided for partial subscription periods
  • We reserve the right to change pricing with 30 days notice

7. Prohibited Conduct

You agree not to:

  • Use the platform for any unlawful purpose
  • Impersonate any person or entity
  • Post false, misleading, or fraudulent content
  • Harass, abuse, or harm other users
  • Attempt to gain unauthorized access to our systems
  • Use automated systems to scrape or collect data
  • Interfere with the proper functioning of the platform
  • Circumvent the platform to avoid paying fees

8. Intellectual Property

All content on Tripzera, including text, graphics, logos, and software, is the property of Tripzera or its content suppliers and is protected by intellectual property laws.

Users retain ownership of content they submit but grant Tripzera a non-exclusive license to use, display, and distribute such content in connection with our services.

9. Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

  • The services will be uninterrupted or error-free
  • Any information provided by travel advisors is accurate or reliable
  • The quality of services from any advisor will meet your expectations

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRIPZERA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OUR SERVICES, INCLUDING BUT NOT LIMITED TO DAMAGES ARISING FROM ANY TRAVEL SERVICES PROVIDED BY ADVISORS ON OUR PLATFORM.

11. Indemnification

You agree to indemnify and hold harmless Tripzera and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of our services or violation of these Terms.

12. Dispute Resolution

Any disputes arising from these Terms or your use of our services will be resolved through:

  • First, informal negotiation by contacting us
  • If unresolved, binding arbitration in accordance with applicable rules

You agree to waive any right to participate in class action lawsuits.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

14. Termination

We may terminate or suspend your access to our services immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use our services will cease immediately.
